Terms and Conditions

These Terms & Conditions (“Terms”) govern all services provided by KH Maintenance (“the Company”) and the use of the Company’s website (“the Website”). By accessing the Website or engaging the Company, the client (“the Client”) agrees to be bound by these Terms.

1. Scope of Services

  • The Company provides property maintenance, heating, plumbing, and associated trade services to domestic and commercial clients.
  • These Terms apply to all quotations, bookings, service agreements, and Website interactions.

2. Website Use

  • The Website is provided for informational and enquiry purposes only.
  • The Client shall not engage in any activity that interferes with the operation, security, or integrity of the Website.
  • The Company reserves the right to amend or withdraw Website content at any time without prior notice.

3. Engagement of Services

  • A service request shall not constitute a confirmed booking until accepted by the Company.
  • The Company undertakes to perform services with reasonable skill, care, and diligence in accordance with industry standards.
  • Any timeframe provided is an estimate only and shall not be contractually binding.
  • The Company may refuse or withdraw services at its sole discretion.

4. Quotations

  • Quotations are based on information provided at the time of enquiry and may be subject to revision following inspection.
  • Unless otherwise stated, quotations remain valid for fourteen (14) days.
  • Additional work required due to unforeseen conditions shall be chargeable as a variation.
  • A quotation shall not constitute a binding contract until accepted by both parties.

5. Pricing, Deposits & Payment

  • The Client shall pay all fees associated with labour, materials, call-outs, diagnostics, and waste removal where applicable.
  • A deposit may be required for works involving material procurement or significant labour allocation.
  • Unless expressly agreed otherwise, payment is due immediately upon completion of the works.
  • Overdue balances may be subject to administrative fees or recovery costs.
  • Title to materials supplied by the Company shall remain with the Company until payment is received in full.

6. Cancellations & Rescheduling

  • The Client must provide a minimum of twenty-four (24) hours’ notice to cancel or reschedule an appointment.
  • Failure to comply may result in a cancellation fee or call-out charge.
  • The Company reserves the right to amend or postpone appointments due to illness, safety concerns, emergencies, or external factors.

7. Client Obligations

  • Provide safe and unobstructed access to the property.
  • Ensure that the working environment is suitable, including the securing of pets, valuables, and sensitive items.
  • Disclose all relevant hazards, structural issues, or property conditions prior to commencement.
  • Obtain all necessary permissions (e.g., landlord or property owner consent).
  • Provide accurate and complete information relevant to the requested works.

8. Materials & Workmanship

  • Materials supplied by the Company shall be fit for purpose and sourced from reputable suppliers.
  • Workmanship shall comply with applicable standards and regulations.
  • Any warranty relating to workmanship shall be outlined at the time of service.
  • The Company accepts no liability for defects arising from:
    • materials supplied by the Client;
    • pre-existing structural or system defects;
    • misuse, negligence, or failure to maintain systems by the Client.

9. Liability

  • The Company shall not be liable for:
    • indirect, incidental, or consequential losses;
    • delays arising from circumstances outside the Company’s control;
    • damage arising from undisclosed defects or hazardous conditions.
  • The Company’s total aggregate liability shall not exceed the contract price for the relevant services.
  • Nothing in these Terms shall exclude liability where such exclusion is prohibited by law.

10. Property Conditions & Unforeseen Issues

  • Should hidden defects or safety risks be identified, the Company may suspend works pending further agreement.
  • Additional costs may apply to remedial or corrective works required as a result of such conditions.

11. Photographs & Records

  • The Company may record photographic evidence of works for documentation, quality assurance, or portfolio use.
  • No identifiable personal data will be published without the Client’s consent.
  • The Client may request non-publication of images.

12. Intellectual Property

  • All Website content, including text, images, graphics, and branding, is the property of the Company unless otherwise stated.
  • Reproduction or distribution of any Website content is prohibited without prior written approval.

13. Data Protection

  • Personal data shall be processed in accordance with the Company’s Privacy Policy and applicable data protection legislation.
  • By engaging the Company, the Client consents to such processing.

14. Third-Party Links

  • The Website may contain links to third-party websites for convenience only.
  • The Company accepts no responsibility for the content or practices of third-party sites.

15. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of Ireland.
  • The courts of Ireland shall have exclusive jurisdiction in relation to any dispute arising under these Terms.

16. Amendments

  • The Company may revise these Terms at any time.
  • Continued use of the Website or Company services shall constitute acceptance of any revised Terms.
